Crew accommodation in Denmark: can the crew live in a summer house over winter?

Short answer

In most cases no: from 1 November to the end of February, a house in a Danish summer house area may only be used for weekends and short holiday stays of up to 3 to 4 weeks, and a worker who registers there must be ordered to move out within 14 days. Since 1 July 2025, housing an employer provides must also keep out cold and damp and hold no more than two people per bedroom unless there are 20 m2 per person. Bonjour Residences data shows most Danish crew stays run for six months or more through the winter, so it advises bookers to check a property's zoning before they book, not the photos.

A contractor needs beds for eight people near Kalundborg from November to April. The flats in town are gone. A broker offers a large wooden house by the coast, 20 minutes from site, four bedrooms, free from Monday. It looks perfect. In Denmark, it may be one of the few places the crew is not allowed to sleep this winter.

Our argument: in Denmark the risk sits in the zoning of the house, not in the house itself. Bookers should check whether a property is in a summer house area before they look at the photos, because from 1 November the law treats a winter-long crew stay there as unlawful.

Why is this a Danish problem right now?

Because the winter ban started on Sunday. Under section 40 of the Danish Planning Act, a home in a summer house area may not be used for overnight stays from 1 November to the end of February, apart from short holiday stays and similar. Municipal guidance sets the limit: stays of at most 3 to 4 weeks, with breaks of at least a week in between. The Danish Supreme Court has ruled that continuous use for 9.5 weeks or more in winter breaks the law.

And the spare stock around the big Zealand projects is exactly this kind of house. Danmarks Statistik figures quoted by TV2 ØST in July count 24,232 summer houses in Odsherred and 8,365 in Kalundborg municipality, the two largest totals in the region. Purpose-built options are scarce: in June, a planned temporary camp with 120 homes for construction workers near a school in Kalundborg was dropped after local opposition.

What happens if the crew registers at the address?

A crew staying six months will often need to register. EU workers can stay up to six months without a CPR number but must apply for an EU residence document within three months, and workers from outside the EU and EEA register after three months. Our guide to stays over three months covers the paperwork. Registration needs an address.

If that address is a summer house the crew cannot lawfully live in all year, section 51a leaves the council no choice. Every 1 November, and within 14 days of any registration made between 1 November and 1 February, it must order the resident to move out within 14 days. If they stay, the council reports it to the police and sets daily fines. Councils can grant exemptions, but Odsherred's guidance is clear: only owners, never tenants.

What does the 2025 accommodation law add?

Since 1 July 2025, the Danish Act on Accommodation of Employees covers any housing an employer provides to staff in Denmark, including summer houses, and it also applies to posted workers. The home must protect against damp, cold, heat and noise, be heatable to a satisfactory indoor climate, and hold no more than two people per bedroom unless there are 20 m2 or more per person. The Danish Working Environment Authority can enter without a court order, take photos and issue an order to fix things, and breaches are fined. A summer house built for July does not always pass a January inspection.

What does our booking data show?

We looked at our 17 non-cancelled crew stays in Denmark, all on Zealand. The median booked length is 180 nights, and 15 of the 17 were booked for 180 nights or more. Sixteen overlap the winter ban period and six span all of it. In 13 of the 17 booking records, the house or flat had at least as many bedrooms as the crew had people. These are long, winter-spanning stays, which is the exact pattern a summer house area cannot take.

The winter ban covers houses in summer house areas. Summer houses in town and rural zones, and year-round homes inside a summer house area, are not covered. So two wooden houses on the same road can sit under different rules.

What should bookers do differently?

  • Ask for the zoning first. Before you look at photos, ask whether the address is in a summer house area. The municipality, the official plan register at plandata.dk and the building register can confirm it.
  • Treat "holiday home" as a winter red flag. For any stay that crosses 1 November to the end of February and runs longer than a few weeks, rule summer house areas out unless the owner can show a lawful year-round use.
  • Plan the registration address. If the crew will register, make sure the address can take it. A move-out order 14 days after registration ends the stay mid-project.
  • Count bedrooms against heads. Two per bedroom is the ceiling when the employer provides the housing. See splitting a crew across flats if one house will not fit them.
  • Check the heating, not the view. Ask how the house is heated and insulated before a six-month winter stay.
  • Book early around big sites. Year-round stock near Kalundborg goes first. Our Kalundborg crew accommodation page shows the area we cover.

FAQ

Can construction workers stay in a Danish summer house in winter?

Only for short stays if the house is in a summer house area: weekends and stays of up to 3 to 4 weeks with breaks between them, from 1 November to the end of February. Summer houses in town or rural zones are not covered by the winter ban.

Can a summer house owner get an exemption for a crew?

Councils can exempt in special cases, but exemptions are personal to the owner. Odsherred's guidance says they are not given to tenants.

Does the two-per-room rule apply to accommodation a booker arranges?

It applies when the employer makes the housing available to its staff in Denmark, including posted workers. Employers covered by a collective agreement with equivalent housing rules are handled under that agreement.
